Welcome to BusinessKit. These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "Customer", "You") and BusinessKit ("Company", "we", "us", or "our"), governing your access to and use of https://businesskit.io and all related applications, APIs, services, and software tools (collectively, the "Service").

1. Acceptance of Terms

By creating an account, browsing our website, subscribing to a plan, or using any feature of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Refund & Cancellation Policy, and Shipping & Service Delivery Policy. If you do not agree to these Terms, you must immediately discontinue use of the Service.

2. Description of SaaS Services

BusinessKit is a cloud-based Software-as-a-Service (SaaS) platform that provides businesses, solo founders, and creators with digital storefronts, billing and GST invoicing, CRM customer management, digital asset downloads, and AI agent workflow automations.

As a digital software platform, all services and software functionalities are delivered electronically and instantly upon registration and payment approval. No physical goods are shipped.

3. Account Registration & Security

To use our services, you must register for an account. By registering, you warrant and agree that:

  • You are at least 18 years of age or have legal capacity to enter into binding contracts.
  • All information provided during registration is accurate, current, and complete.
  • You are solely responsible for maintaining the confidentiality of your account credentials.
  • You will notify us immediately at support@businesskit.io upon discovering any unauthorized use of your account.

4. Pricing, Billing & Payment Processing

4.1 Payment Gateways

Payments on BusinessKit are processed securely through certified third-party payment gateway partners, including PayU Payments Private Limited ("PayU"), Stripe, and authorized banking partners. By initiating a transaction, you authorize us and our payment gateway partners to charge your designated payment method.

4.2 Subscriptions & Renewals

Paid features are billed on a recurring subscription basis (monthly or annually) as specified at checkout. Subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date via your account dashboard.

5. Cancellation & Refund Policy

We offer a transparent 14-Day Money-Back Guarantee for new subscription plans. If you are not satisfied with the Service, you may cancel your plan and request a full refund within 14 days of purchase by contacting refunds@businesskit.io.

Approved refunds will be processed back to the original payment source via PayU within 5–7 business days. Please review our dedicated Refund & Cancellation Policy.

6. Service Fulfillment & Delivery

7. User Obligations & Acceptable Use

You agree not to use the Service to:

  • Violate any local, state, national, or international law or regulation.
  • Transmit any unlawful, infringing, fraudulent, defamatory, or harmful content.
  • Distribute viruses, malware, or malicious code designed to compromise system integrity.
  • Attempt unauthorized access to our servers, user accounts, or connected infrastructure.
  • Reverse-engineer, decompile, or copy any software or proprietary algorithms of the platform.

8. Intellectual Property & Data Ownership

All rights, title, and interest in the BusinessKit platform and software belong to BusinessKit. You retain 100% ownership of all customer data, files, and content stored in your account database.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of competent courts.
